欢迎使用「汪汪日记」（App Store 完整名称为「汪汪日记 - 遛狗足迹地图」，下称"本应用"）。本协议是你与我们之间就使用本应用达成的约定。请在使用前仔细阅读。你点击"同意并继续"、或开始使用本应用，即表示你已阅读并同意本协议全部条款。

一、本应用是什么

• 本应用是一款供你个人使用的遛狗与影像记录工具：在本地记录遛狗轨迹、生成足迹地图、以狗狗视角生成散步日记，并整理你相册中的宠物照片形成回顾。
• 本应用不含任何游戏内容、虚拟货币、概率获取机制。如未来提供付费项目，均为明码直购。
• 本应用不设账号体系，不收集手机号、邮箱等身份信息（详见《隐私政策》）。

二、你的账户与设备

• 本应用无需注册登录，你以设备本机的方式使用。你的全部记录数据保存在你的设备本地。
• 你应自行妥善保管你的设备与数据。卸载本应用将删除全部本地数据且无法恢复；更换设备时数据不会自动迁移。

三、你的内容与授权

• 你在本应用中产生或整理的内容（遛狗轨迹、日记文本、你选择的照片、便签等，下称"你的内容"）归你所有。
• 你的内容仅在你的设备本地处理与保存。你使用系统分享功能将日记卡片、足迹相册或成片分享到你自选的其他应用时，由你自行决定分享对象与范围，相应后果由你承担。
• 你承诺对你在本应用中提供或整理的内容拥有合法权利，不侵犯他人知识产权、隐私或其他合法权益。

四、你应遵守的规则

使用本应用时，你不得：

• 利用本应用从事任何违反法律法规、公序良俗或侵害他人合法权益的行为；
• 对本应用进行反向工程、反编译、破解，或以非正常手段干扰、破坏本应用及其服务器的正常运行；
• 恶意、批量或以自动化方式调用本应用的日记生成服务，或规避每日生成上限等使用限制；
• 利用基于深度学习、虚拟现实、生成式人工智能等新技术新应用制作、上传、复制、传送、传播虚假新闻信息等法律法规禁止的信息内容，或将合成内容谎称为自然内容。你在对外发布或传播由本应用生成的日记、成片、分享卡片等非真实信息时，应当以显著方式予以标识；否则我们有权对相关内容和分享链接采取包括但不限于增加标识、限制、停止托管等措施。

五、日记生成服务说明

• 散步日记与影像日记文案由第三方大模型服务生成（第三方接收方与脱敏范围见《隐私政策》第三部分）。生成内容基于你的真实散步数据与永真的狗行为想象，仅供娱乐与记录，不构成任何事实陈述或建议。
• 本应用生成的日记、周记、成片与分享卡片均属人工智能生成合成内容，不是对现场事实的客观记录，也不代表你的狗狗的真实想法。请勿将其作为新闻、事实陈述或专业建议对外发布或传播。
• 网络不可用或服务异常时，本应用会在本地生成模板日记，保证记录不中断。

六、知识产权

• 本应用的软件、界面设计、插画形象、文案模板及相关标识的知识产权归我们或相应权利人所有。
• 未经书面许可，你不得复制、修改、分发、出售或以其他方式商业利用本应用的上述内容。你个人使用中生成的日记与卡片，你可自由分享与保存。

七、免责与责任限制

• 本应用按"现状"和"现有"基础提供。在法律允许的最大范围内，我们不对本应用的适用性、连续性、无差错性作出明示或默示的保证。
• 定位精度受设备硬件、卫星信号与环境影响，可能存在误差；本应用不应被用于导航、救援或任何对精度有严格要求的用途。
• 在法律允许的范围内，对于因使用或无法使用本应用导致的间接、偶然或后果性损失，我们不承担责任。

八、协议的变更与终止

• 我们可能因功能迭代或法律法规要求更新本协议。协议发生重大变更时，我们会在你下次启动应用时重新展示并征得你的同意。
• 你可以随时停止使用并卸载本应用以终止本协议。

九、未成年人使用

本应用面向一般用户，不专门面向未成年人。若你是未成年人，请在监护人陪同并同意后使用本应用。

十、法律适用与联系我们

• 本协议的订立、效力、解释及争议解决，适用中华人民共和国大陆地区法律，但你所在国家或地区的法律另有强制性规定的除外。
• 对中国大陆以外用户的保留条款：本协议不排除、不限制你依据所在国家或地区法律享有的、依法不可通过合同排除的强制性消费者权利（包括但不限于法定担保、退款、争议解决途径等）。若本协议任一条款在你所在法域被认定为无效或不可执行，该条款在该法域内按最小必要范围调整或不予适用，其余条款继续有效。
• 本条第七部分的免责与责任限制，仅在你所在法域法律允许的最大范围内适用；法律不允许排除或限制的责任，不受该部分影响。
• 如对本协议有任何疑问、意见或投诉，请联系：privacy@daikaverse.com。我们将在 15 个工作日内答复。

十一、Terms of Service (English Summary)

This English section is provided for users outside mainland China. The Chinese text above is the authoritative version; where the two differ, the Chinese text governs.

• What Pawtrail is: a personal dog-walking and photo-journal tool. It records walks locally, draws a fog-of-exploration map, writes a diary from your dog's point of view, and organizes pet photos already in your library. It contains no game content, no virtual currency, and no chance-based acquisition mechanics. Any future paid items will be fixed-price direct purchases.
• No account: there is no sign-up or login. All of your records are stored locally on your device. Uninstalling the app permanently deletes all local data; data does not migrate automatically to a new device.
• Your content is yours. Walk tracks, diary text, photos you select and notes you write belong to you. When you use the system share sheet to send a card, photo book or film to another app, you choose the recipient and scope and are responsible for that choice.
• Diary text is generated by a third-party large-language-model service from a de-identified summary (recipients and the exhaustive field list are in the Privacy Policy). It is written for entertainment and record-keeping; it is not a statement of fact or advice. When the network is unavailable, the app generates a local template diary instead.
• Acceptable use: do not reverse-engineer or interfere with the app or its servers, and do not call the diary service in an automated or bulk manner or circumvent the daily generation limit.
• Disclaimer: the app is provided "as is" and "as available". Location accuracy depends on device hardware, satellite signal and environment; the app must not be relied on for navigation, rescue, or any purpose with strict accuracy requirements.
• Governing law: these terms are governed by the laws of the mainland of the People's Republic of China, except where mandatory law in your country or region provides otherwise. Nothing in these terms excludes or limits any mandatory consumer right you hold under the law of your place of residence that cannot be waived by contract. If any provision is held invalid or unenforceable in your jurisdiction, it applies there only to the minimum extent permitted, and the remaining provisions stay in force. The limitations of liability above apply only to the maximum extent permitted by the law applicable to you.
